Clause 2: Applicable law - Disputes


Orders are subject to French law.
The contractual information is presented in French and the products presented for sale comply with French regulations.
If necessary, it is up to the foreign customer to check with the local authorities the possibilities of using the product he plans to order; Gaïani cannot be held liable in the event of non-compliance with the regulations of a foreign country where the product is delivered.

In the event of a dispute, the court of Nîmes has sole jurisdiction.


Clause 3: Presentation of products


The characteristics of the products offered for sale are presented on the product sheets.
These products are subject to slight variations given their artisanal production, each piece being unique.
Gaïani cannot be held liable if errors have been introduced.

All the texts and images presented on the Gaïani site are reserved under copyright and intellectual property rights; their reproduction, even partial, is strictly prohibited.



Clause 4: Period of validity of sales offers

The products are offered for sale while stocks last. In the event of an order for a product that has become unavailable, the customer will be informed of this unavailability, as soon as possible, by e-mail or by post, an exchange or a refund will then be offered to him.

Clause 5: Product prices


The product sheets indicate the prices in euros all taxes included, excluding shipping costs. The amount of the shipping costs appear on the screen at the end of the selection of the various products by the customer.

Gaïani reserves the right to modify its prices at any time, but the products ordered are invoiced at the price in effect when the order is recorded.

Clause 6: Order


The customer validates his order when he activates the "Confirm your order" link; he then accepts the ordering process and these conditions of sale. Gaïani confirms the order by e-mail; this confirmation includes all the elements of the order.

The data recorded by Gaïani constitutes proof of the nature, content and date of the order. This is archived by Gaïani; the customer can access this archive by contacting Customer Service.

In the event of an order cancellation, Gaïani will refund the sums collected. In the event of the exceptional unavailability of an article, Gaïani may offer a similar article for the same amount, send the article within a period agreed with the buyer or send a refund.


Clause 7: Payment


Payment for purchases is made:

- By secure payment via Paypal with or without an account.

- By credit card via Paypal without an account.
- By check to the address indicated on your order form.


Clause 8: Delivery


Products purchased from Gaïani can be delivered in mainland France, in tracked shipments via the Post Office and in all member countries of the European Community. The times indicated are usual average times and correspond to processing and delivery times.

The products are delivered to the address indicated by the customer during the ordering process.

In case of deliverable items on different dates given their availability, the delivery time is based on the longest time.

Gaïani cannot be held responsible for the consequences due to a delay in delivery. In case of delay an email is sent to the customer.

In the event of payment by credit card, the periods indicated above run from the day of registration of the payment and correspond to the processing and delivery times.

In the event of payment by paypal, the deadlines indicated above run from the day of registration of the payment and correspond to the processing and delivery times.

The customer must notify the carrier and Gaïani of any reservations about the product delivered (for example: damaged package, already opened, etc.) and this upon receipt of the package(s).

If the package arrives open or damaged or the items arrive damaged, it is essential that the customer have the postman or the post office on which he depends draw up a "spoliation report" (report 170) so that Gaïani can open an investigation. and a compensation procedure.

Any claim received after the deadline or not including a "spoliation report" will be rejected.

Depending on the cases defined, the customer may benefit from the exchange and refund conditions provided for in the said article.


Clause 9: Data confidentiality


The personal data provided by the customer is not disseminated to third parties; they are, unless expressly opposed by the customer, integrated into Gaïani's customer file.

In accordance with law 78-17 of January 6, 1978, the customer has at any time a right of access and rectification. To exercise this right, simply contact the company's Customer Services.


Clause 10: application of these T&Cs


The GCS include a vintage - they are applicable as long as they appear on the site - Gaïani reserves the right to modify them - the new conditions apply as soon as they are published - nevertheless the GCS that appeared on the site at the time of the order of the customer remain applicable to him.
